Abstract

This study examines marriage dispensation applications from the perspective of marriage law in Indonesia. Changes in the provisions for applying for dispensation indicate a shift in the requirements for applying for dispensation. This study compares regulations between Law Number 1 of 1974 and the latest revision, Law Number 16 of 2019. The presence of witness statements, which should be a mandatory requirement for proof, elements of urgent reasons and other evidence that strengthen the trial must be granted. The results of this study require public outreach and provide optimal child protection efforts by emphasizing the serious impacts of early marriage.
