Juridical Analysis of the Legal Status of Children Born from Unregistered Marriages after Constitutional Court Decision No. 46/PUU-VIII/2010

Abstract

The development of family law regulations in Indonesia has been progressing rapidly, in line with the many dynamic legal phenomena and regulatory changes. The Constitutional Court Decision Number 46/PUU-VIII/2010 marks an important paradigm shift and has significantly influenced the development of family law in Indonesia. A prominent issue currently is the legal status of children born out of wedlock. This legal change has had a notably significant impact on the civil aspects concerning children born from marriages that are not officially recognized according to statutory regulations. This study comprehensively examines the legal status of children born from unregistered marriages after the Constitutional Court decision, by analyzing the civil relationship between the child and the biological father.
